Contingency Provision. In the event this Grant is terminated for any reason, the CARB Executive Officer or designee reserves the right in his or her sole discretion to award a grant to the next highest scored applicant and if an agreement cannot be reached, to the next applicant(s) until an agreement is reached. CARB may also elect to award a grant in a manner consistent with direction provided in the FY 2021-22 Funding Plan and/or FY 2022-23 Funding Plan, which may include but is not limited to allocating the funds to other projects.
Contingency Provision. In the event this Grant Agreement is terminated for whatever reason, the CARB Executive Officer or designee reserves the right in his or her sole discretion to award any remaining funds to other projects.
Contingency Provision. In the event of a court decision or a change in Oklahoma Statutes that impacts on the budget or efficient operation of the school district, the Board and Association will immediately resume bargaining in order to negotiate conditions or items affected by the change. All provisions of the Negotiations Procedural Agreement will be followed.
Contingency Provision. If the implementation of any provision of this Agreement would reduce County revenue pursuant to 1991 State Legislation, then such provision will not be implemented and the parties will meet and confer on alternatives.
Contingency Provision. Should Children’s Center funding sources be reduced at any time during the term of this Agreement, the District shall have the right to open negotiations on the salary and fringe benefits of Children’s Center employees.

In the event this Grant Agreement is terminated for whatever reason, the NASRC Executive Officer or designee reserves the right in his or her sole discretion to use or make the Grant Funds available in a manner consistent with applicable laws, policies and the applicable FRIP Program Guidelines requirements, which may include but is not limited to allocating the Grant Funds to other projects or awarding the Grant to the next highest scored applicant and if an agreement cannot be reached, to the next applicant(s) until an agreement is reached.
Contingency Provision. It is mutually agreed that in the event changes in the law of the State of Illinois should occur affecting this contract in its entirety and rendering the same null and void in all of the above terms and conditions, then this contract shall become merely a memorandum of understanding without legal efficacy between the parties; and in the event a part of the terms and provisions hereinabove set forth shall become null and void, then only that part rendered void shall become inoperative between the parties and the remaining terms and provisions shall be binding upon the parties hereto.

Contingency Provision. In the event any Article, Section, or portion of this Agreement should be held invalid and unenforceable by any Board, Agency, or Court of competent jurisdiction, such decision shall apply only to the specific Article, Section, or portion thereof specifically specified in the Board Agency, or Court decision; and upon issuance of such a decision, the CITY and the UNION agree to immediately begin negotiations on a substitute for the invalidated Article, Section, or portion. thereof.
