CONSTRUCTION PHASE SERVICES FEE. For the construction phase of the contract, I/we agree to perform all construction items of the project including profit and overhead for the itemized Guaranteed Maximum Price (GMP) at 100%. If the City and Contractor cannot agree on the GMP, then the construction phase will be advertised and put to formal bid, per Heber City’s Procurement Policy. Contractor’s Performance & Payment Bond and Insurance – This fee is for all bonds and insurance associated with the construction phase of the contract, based upon the indicated percentage of the cost of construction (agreed upon GMP). Construction Management Fee – Part of the construction phase GMP and includes overhead (e.g., home office), profit, and personnel who will be managing the project during bidding, construction, and closeout, including the warranty period of one-year.

Contractor is not entitled to reimbursement for any costs incurred for Pre-Construction Phase Services performed before issuance of the written Notice to Proceed.
