Common use of Construction Labor Costs Clause in Contracts

Construction Labor Costs. The cost of labor for direct performance of construction Work will equal the sum of the following, plus a 35 percent xxxx-up, which shall constitute full compensation for construction labor costs:  Contractor payment to the worker for:  Basic hourly wage;  Health and welfare;  Pension;  Vacation;  Training; and  Other State of California and federal recognized fringe benefit payments.  The labor surcharge percentage listed for the following items in the current California Department of Transportation publication that lists labor surcharge and equipment rental rates:  Workers’ compensation insurance;  Social security;  Medicare;  Federal unemployment insurance;  State of California unemployment insurance;  State of California training taxes;  Subsistence and travel allowances paid to the workers; and  Contractor payment to supervisors, if authorized. The 35 percent xxxx-up consists of payment for all overhead costs related to labor but not designated as costs of labor used in the direct performance of the Work, including:  Home office overhead;  Field office overhead;  Bond costs;  Profit;  Labor liability insurance; and  Other fixed or administrative costs that are not costs of labor used in the direct performance the Work.
