Common use of Construction, and Repair Clause in Contracts

Construction, and Repair. The Transmission Owner may interrupt interconnection service or curtail the output of the Small Generating Facility and temporarily disconnect the Small Generating Facility from the Transmission Owner’s Transmission System when necessary for routine maintenance, construction, and repairs on the Transmission Provider’s Transmission System. The Transmission Owner shall provide the Interconnection Customer with five Business Days notice prior to such interruption. The Transmission Owner shall use Reasonable Efforts to coordinate such reduction or temporary disconnection with the Interconnection Customer. Upon request by the Interconnection Customer, the Transmission Owner will consider performing maintenance during a time period other than as scheduled by the Transmission Owner, provided that it might not reasonably be expected to have an adverse impact upon the Transmission Owner’s operations, other customers of the Transmission Owner as determined by the Transmission Owner, or increase the cost of any maintenance, construction or repair. Forced Outages During any forced outage, the Transmission Owner may suspend interconnection service to effect immediate repairs on the Transmission Owner’s Transmission System. The Transmission Owner shall use Reasonable Efforts to provide the Interconnection Customer with prior notice. If prior notice is not given, the Transmission Owner shall, upon request, provide the Interconnection Customer written documentation after the fact explaining the circumstances of the disconnection.
