Consequences of Contractor Defaults. 44 (A) Class A Default. In the event of a Class A default, the Contractor or Surety shall 45 be permitted to remedy the default within three (3) days from notice by the County and 46 shall pay to the County from the date of that notice to the date the default is remedied, 47 liquidated damages in the amount of $125,000 per day. If the Class A default is not 48 remedied within three (3) days of that notice, the County may, at its sole option: 1 (1) be released from its obligations under this Contract and use any other 2 method or Person to Transport and/or Dispose of Waste and may sue for actual damages; 4 (2) seek judicial remedy of specific performance; or 6 (3) pursue any combination of the foregoing or any other remedy provided 7 under this Contract.
