Connection Facilities. 6.1 BGE and TranscoNGG agree to consult and cooperate with a view to ensuring that the objective in clause 6.2 is satisfied. 6.2 The objective is that, without prejudice to clause 3.2, in all material respects the TranscoNGG Facilities and the BGE Facilities are and will continue to be technically and operationally compatible, as facilities by which the TranscoNGG System and the BGE System may safely be connected. 6.3 Where, by reason of any modification, other than a modification made to comply with any Legal Requirement, made or to be made by TranscoNGG to the TranscoNGG Facilities or by BGE to the BGE Facilities, the objective in clause 6.2 ceases or will cease to be satisfied, such Operator shall reimburse to the other any material expenditure reasonably incurred by the other for the purposes of ensuring that the objective continues to be or is again satisfied. 6.4 Each Operator shall be entitled, upon reasonable notice to the other, to inspect the other's Connection Facilities (and to have access to the site thereof accordingly), for the purposes of determining whether the objective in clause 6.2 is satisfied. 6.5 Without prejudice to any other agreement between TranscoNGG and BGE in respect of the installation of the TranscoNGG Facilities or the BGE Facilities, subject to the provisions of this clause 6, nothing in this Agreement shall impose any obligations upon either Operator or take effect as a warranty by either Operator in relation to its System; and neither Operator will be liable to the other in respect of any failure or malfunction thereof.

6.2 The objective is that, without prejudice to clause 3.2Clause 3.2(a) of this Agreement, in all material respects the TranscoNGG Transco Connection Facilities and the BGE Storage Connection Facilities are and will continue to be technically and operationally compatible, as facilities by which the TranscoNGG System and the BGE System Storage Facility may safely be connectedconnected and operated.
6.3 Where, by reason of any modification, other than a modification made to comply with any Legal Requirement, made or to be made by TranscoNGG either Operator to the TranscoNGG Facilities or by BGE to the BGE its Connection Facilities, the objective in clause Clause 6.2 ceases or will cease to be satisfied, such Operator shall reimburse to the other any material expenditure reasonably incurred by the other for the purposes of ensuring that the objective continues to be or is again satisfied.
6.4 Each Operator shall be entitled, upon reasonable notice to the other, to inspect the other's ’s Connection Facilities (and to have access to the site thereof accordingly), for the purposes of determining whether the objective in clause Clause 6.2 is satisfied.
6.5 Without prejudice to any other agreement between TranscoNGG Transco and BGE the Storage Operator (including any Storage Agreement or Transportation Arrangement, or any agreement in respect of the installation of the TranscoNGG Transco Connection Facilities or the BGE Storage Connection Facilities), subject to the provisions of this clause 6Clause 6.3 and 6.4, nothing in this Agreement shall impose any obligations upon either Operator or take effect as a warranty by either Transco in relation to the System or the Storage Operator in relation to its System; the Storage Facility and neither Operator will be liable to the other in respect of any failure or malfunction thereof.
6.6 Subject to the provisions of any other agreement between the Operators, where pursuant to this Agreement either Operator (the “first Operator") is required or entitled to have any measurement or other equipment installed on land or buildings or plant which the other owns or operates, the first Operator shall retain ownership of such equipment (unless it has become a part of land owned or occupied by the other) and shall have such reasonable access and other rights (without undue disturbance of the other) as are required to maintain, repair, replace, inspect and operate such equipment, provided that the first Operator shall comply with such reasonable safety and site procedures as may be imposed by the other Operator.
