Conduct of Business by Tenant. Tenant covenants and agrees during the Term that:
(a) Tenant shall continuously use the Premises as a nursing home with 159 beds, or such other number of beds as Tenant may determine appropriate, subject to the prior written consent of Landlord, not to be unreasonably withheld or delayed, and, at Tenant's election, for the provision of such other health care services as may be permitted under Applicable Law which are ancillary to Tenant's operation of the Premises as a nursing home, including, without limitation, the provision of subacute care services, home health care services, and outpatient therapy services, and Tenant may locate on the Premises such physician and other health care professional and administrative offices as may be ancillary to Tenant's operation of the Premises as a nursing home (collectively, the "Permitted Use"); and Tenant shall not use the Premises for any other purposes without the prior written consent of Landlord, which consent may be withheld at the sole and absolute discretion of Landlord. Notwithstanding the foregoing, any portion of the Premises not used by Tenant as of the Lease Commencement Date in connection with the operation of the Facility may be used for any purpose not inconsistent with Tenant's use of the Premises to operate the Facility as a nursing home, subject to Applicable Law.
(b) Tenant shall maintain good standing and all material licenses, certifications and approvals from federal, state and local governmental and administrative agencies having jurisdiction and authority over Tenant and the operation of the Facility as a nursing home, including without limitation, all nursing home licenses required from the State and all licenses required for any material ancillary uses for which the Premises are used. Upon request, Tenant shall provide Landlord with copies of the aforesaid licenses, certifications and approvals. Tenant also shall promptly provide Landlord with notice of any delicensure or decertification proceedings affecting Tenant's operation of the Facility.
(c) To the extent the Premises are subject to a Fee Mortgage that is insured or otherwise supported by an agency of the Federal, state or local government, such as HUD or FHA, Tenant will comply with all requirements imposed with respect to the use, occupancy and operation of the Premises by such governmental agencies, including but not limited to submitting certified financial statements and reports, maintaining reserves and escrow accounts require...
Conduct of Business by Tenant. Tenant shall operate the business in the Premises in accordance with all applicable codes, regulations, statutes and ordinances applicable to the Premises and Tenant's business, and in accordance with the Governing Documents and all covenants, declarations and restrictions imposed on the Premises by the Shopping Center of which the Premises are a part, and shall indemnify Landlord against any costs or damages which Landlord may incur which are a result of Tenant having failed to so operate its business in the Premises.
Conduct of Business by Tenant. 7.1 Tenant shall use and occupy the Premises during the Term of this Lease solely for the use specified in the Basic Lease Information and for no other use or uses without the prior written consent of Landlord.
7.2 Tenant shall not use or occupy, or permit the use or occupancy of, the Premises or any part thereof for any use other than the use specifically set forth in Article 7.1 hereof, or in any manner that, in Landlord's judgment, would adversely affect or interfere with any services required to be furnished by Landlord to Tenant or to any other tenant or occupant of the Building, or with proper and economical rendition of any such service, or with the use or enjoyment of any part of the Building by any other tenant or occupant.

Conduct of Business by Tenant. 5.01 Use of Premises Tenant shall use the Premises solely for the purposes as set forth in Paragraph 1.03. Tenant shall occupy the Premises on and after Term Commencement Date and shall conduct continuously in the Premises the business above stated. Tenant shall not conduct Internet or catalogue sales in or from the Premises except of merchandise which Tenant is permitted to sell “over the counter” in or at the Premises.
Conduct of Business by Tenant. 5.1 Tenant shall use the Premises during the Term of this Lease solely for general office use and for no other use or uses without the prior written consent of Landlord, which Landlord may give or withhold in Landlord’s sole discretion.
5.2 Tenant shall not use or occupy or permit the use or occupancy of the Premises or any part thereof for any use other than the use specifically set forth in Section 5.1, or in any manner that would conflict with the provisions of this Lease or that, in Landlord’s reasonable judgment, would adversely affect or interfere with any services required to be furnished by Landlord to Tenant or to any other tenant or occupant of the Building, or with the proper and economical provision of any such service, or with the use or enjoyment of any part of the Building by any other tenant or occupant thereof, or that would conflict with or violate any permit or certificate of occupancy or completion required or issued for the Premises or any other part of the Building.

Conduct of Business by Tenant. 5.1 During the Term, Tenant shall use and occupy the Premises solely for general business office and computer service activities and storage related to such permitted use. Tenant shall not use the Premises for any other use or uses without Landlord's prior written consent, which may be withheld in Landlord's sole and absolute discretion.
5.2 Tenant shall not use or occupy, or permit the use or occupancy of, the Premises or any part thereof for any use other than the use specifically set forth in Section 5.1, or in any manner that, in Landlord's judgment, would adversely affect or interfere with (a) any services required to be furnished by Landlord to Tenant, or (b) the proper and economical rendition of any such service.
5.3 Tenant will not cause any Hazardous Substance (as defined in this Section 5.3) to be brought, kept or stored on or about the Premises that violates any applicable law, rule, regulation or ordinance, and Tenant will not engage in or permit any other person to engage in any activity, operation or business upon the Premises that involves the use, generation, manufacture, refining, transportation, treatment, storage, handling or disposal of any Hazardous Substance that would or could result in Tenant, Landlord or the Premises to be in violation of any law, statute, ordinance or regulation or rule law pertaining to Hazardous Substances, health, industrial hygiene or the environment. Tenant shall be liable for all clean-up of the Premises due to any violation of this Section 5.3 by Tenant. "Hazardous Substance" shall include, without limitation, those substances, materials and wastes that are or become regulated under applicable local, state or federal law, or the United States government, or which are classified as hazardous or toxic under federal, state or local laws or regulations. Tenant shall indemnify, defend and hold harmless Landlord of, from and against, any and all loss, cost, liability, claim, cause of action, right of action, damage and expense, including, without limitation, penalties, fines and counsel fees, arising from or related to Tenant's violation of this Section 5.3, which indemnity shall survive the expiration or sooner termination of this Lease.
Conduct of Business by Tenant. Recognizing that it is in the interest of Tenant's successful operation of his business, Landlord shall allow Tenant at Tenant's election to be open for business daily, including Sundays and Holidays, and Landlord shall not interfere, by regulation or other imposition, with the hours or the days of business operation by the Tenant. The Tenant covenants and agrees that from and after its initial opening for business, it will operate and conduct within the premises the business which it has been licensed and permitted to operate or such other lawful business licensed and permitted by Landlord.
Conduct of Business by Tenant. 12.1 During this lease the Tenant shall trade in and keep the Leased Premises continuously open to the public during the business hours as determined from time to time by the Landlord as being beneficial to the Centre. The foregoing obligations shall be suspended, however, on such days during which strikes, lock-outs or other similar circumstances beyond the Tenant's control render it unreasonable for the Tenant to trade from the Leased Premises.
12.2 The Tenant shall confine its trading and marketing activities within the boundaries of the Leased Premises and the Tenant shall not sell nor display either merchandise or advertising materials or solicit sales in the Common Areas, nor use or permit the use of any Automatic Teller Machines (or such like), vending machines or amusement machines nor permit the holding of sales by public auction at or about the Leased Premises without the prior written consent of the Landlord, which may attract a charge determined by the Landlord and which consent shall not be unreasonably withheld. The Tenant shall not in any way advertise or represent that it conducts its business in the Leased Premises other than on a normal retailing basis. More particularly the Tenant shall not advertise or represent that the business conducted in the Leased Premises is a factory shop and shall refrain from displaying laminated or non-laminated notices, stickers, paper cut notices, posters, or stick on price tags on any menu boards, walls, windows, shop fronts or any other shop fitting inside or outside the leased premises.
12.3 The Tenant shall not perform any acts or carry on any practices which may injure the Centre or detract from its appearance or be a nuisance or menace to other tenants in the Centre.
12.4 Subject to the provisions of Clause 15 and Annexure B, the Tenant shall provide, install and at all times maintain and where necessary replace, in the Leased Premises all suitable furniture, fixtures, fittings and equipment necessary for the conduct of the Tenant's business therein in a professional and business-like manner.
12.5 The Tenant shall carry at all times in the Leased Premises a stock of merchandise of such quantity, character and quality as shall be required to produce the maximum return to the Tenant and Landlord and shall staff the Leased Premises at all times with sufficient trained personnel to serve its customers.
