Common use of Condemnation Near End of Term Clause in Contracts

Condemnation Near End of Term. Notwithstanding any provisions of Sections 11.2 or 11.3 to the contrary, if Condemnation of any Property occurs during the last two (2) years of the Term (including any automatic Extended Terms) and if restoration cannot reasonably be expected to be completed prior to the date that is twelve (12) months prior to the end of the Term, the provisions of Section 11.1 shall apply as if such Property had been totally or partially taken and the Hotel thereon rendered Unsuitable for its Permitted Use.
