Common use of Codes and Guidelines Clause in Contracts

Codes and Guidelines. 11.2.1 The Deliverables shall be produced in accordance with Assurance Process and the Codes and Guidelines in force as at the date of this Agreement. 11.2.2 If there is any amendment to, replacement of or addition to any of the Codes and Guidelines following the date of this Agreement, the Supplier shall at the written request of the Authority make any consequential changes to the Deliverables which are necessary to comply with the amended, replaced or additional Codes and Guidelines and shall be allowed a reasonable extension of time for completion of the Services so affected. Where such change to the Codes and Guidelines arises directly as a result of any act or omission of the Authority or as a result of any change in best practice, guidance or law, the Supplier shall be entitled to be reimbursed by the Authority for its reasonable and pre-approved costs (if any) incurred in making such changes. In all other cases, the Supplier shall bear any additional costs arising as a result of such change. If the Supplier fails to make any such consequential changes within a reasonable period of time following the Authority's request, then, subject as provided in clause 5.4, the Authority may at its election treat the Supplier's failure as an Event of Default for the purposes of clause 27.1.
