Changed Rationale. When a hospital buys a physician group, one basic rationale for a non-competition agreement turns upside down. The hospital is not the person who built the practice, and the hospital is not the person who taught the profession and the business of medicine to the younger physicians in the group. Therefore, the hospital may seem to have less moral or economic claim over the practice than would a founding doctor.
