Carrier's Obligation. Carrier shall not be liable for delay or failure to perform under this Contract resulting from an event or act of Force Majeure. Carrier's obligations, including, but not limited to, rendering services under this Contract, shall be reduced or suspended for any period in which an event or act of Force Majeure exists as to Carrier and which can not be overcome by Carrier through providing Shipper with a suitable substitute service as identified in Subsection 2.5., above. In the event of any reduction or suspension of Carrier's obligation to render service under this Subsection, Shipper may obtain services from another operator for the period of Force Majeure.

  • HIRER’S OBLIGATIONS a) The Hirer acknowledges having received the Vehicle in a clean condition, with a full fuel tank and full bottle of gas (if applicable). The Hirer will return the Vehicle in a clean condition with a full fuel tank and a full bottle of gas (if applicable, and subject to any pre-purchase fuel and/or pre- purchase gas option being taken), on the Return Date at the time and at the Return Point set out in the Rental Agreement.
