19.05 Employees who are required to work compensated at times when school is closed will be paid a their regular rate of pay unless: (a) for two times the day is one that the District is required to make up in order to complete the required school year as approved by the Board, and (b) the total hours worked are (eight (8) hours worked on a calamity day equals sixteen (16) hours pay at regular rate). Such employees shall be paid at this double time rate for not more than a total of five (5) calamity days within a particular school year. Notwithstanding the foregoing language, should the sheriff declare a Level 3 emergency in a county in which the a district school is located, an employee who works at that school is otherwise entitled to overtime compensation.
19.06 Employees who are not required to report for to work during the shift in which the Level 3 emergency occurs. In addition, any hours worked on a calamity day which was forgiven by the State Department of Education shall be paid at the double time rate. All employees affected by this clause shall be required to return to work when school is closed and who fail to report will not receive any compensation for that day and may be subject to disciplinary actionthe number of State defined calamity days have been exhausted.
19.07 Non 12-month 15.03 This time worked shall not be regarded as overtime, nor compensated for as such.
15.04 The immediate supervisor shall determine which employees who are required to work on both calamity days and the duration of such scheduled work. Day shift employees shall be contacted first. This Section does not apply to custodial coverage for an extracurricular activity that occurs on a calamity day and a make-up day but that falls outside the regularly scheduled work hours of the employees required to work such calamity day, it being understood that custodial coverage for such an extracurricular activity, if needed, will be paid for working the make-up day at their regular hourly rate of payprovided in accordance with Section 15.05 below.
19.08 In 15.05 With respect to an extracurricular activity scheduled on a calamity day, which extracurricular activity falls outside the event regularly scheduled work hours of an inclement weather delaythe employees required to work on such calamity day, employees not listed in Article 19.02 whose day coincides the immediate supervisor shall determine which custodians are required to work with the start of the student instructional day shall have further understanding that such determination will be on a delayed report time equivalent to that of the delay, except for custodial/maintenance-grounds employees who shall report as directed rotation basis by their supervisorclassification seniority.

CALAMITY DAYS. 19.01 The SuperintendentA. The decisions of the Superintendent or designee(s) as to employees who may be dismissed early or start late shall not be subject to grievance. This may result in some employees being required to work their normal hours while others are dismissed early or start late. No employee shall be entitled to overtime or additional compensation for working their normal hours in the event of an early dismissal or late start. Educational Assistants whose duties pertain only to students who are not present at school or on the bus during early dismissals or late starts may report late or leave early in accordance with the general late start or early dismissal times for their school without loss of pay and without being required to complete their normal work shift.

All employees are required to make-up their regularly scheduled hours of work except for hours as a result of delay days at their regular rate of pay as per the required number of days as contracted for all days beyond the ten (10) permitted calamity days. Make-up scheduling options will be provided by the Superintendent in collaboration with the Union President on an annual basis, and make-up may include additional student learning continues instructional days added to the end of the school year up and through Memorial Day, Spring Break and so forth. If make-up student instructional days are added, such plan will be developed and released to the employees prior to September 30. If the Superintendent declares a delay or early release due to calamity, such declaration does not impact any other work shift for employees, other than the work shift for which the delay or early release is declared. (For example, if first shift custodial start is delayed, second and third shift custodial start is not impacted.) All employees on non-impacted work shifts report for duty as regularly scheduled on delay and early release due to calamity. Employees on work shifts that are impacted by the declaration of delay or early release due to calamity have up to two (2) hours flexibility in reporting for duty, or dismissing from duty, as the case may be for delay and early release declarations, respectively. Employees on work shifts that are impacted by the declaration of delay or early release due to calamity will receive regular rate of pay except if directed by the administration to report at a remote or distance learning setting.
19.04 Specific job duties or responsibilities may require some particular time and in such case, those employees will be paid at time and one-half (1.5) for all hours directed to work on delay/early release due to calamity. Whenever the Board requires an employee to report to work in the instance on such days as a condition of Level 2 snow emergencies. The Superintendent/designee determines whether or not conditions are too hazardous to expect employees to report for work at the regularly scheduled timecontinued employment, that employee shall receive compensatory time off at a later timetime mutually agreeable to both supervisor and employee, or not at all. CALAMITY DAYS. 19.01 The When schools are closed by the Superintendent due to a calamity, custodial members of the Bargaining Unit Members may be required to report for duty as required in this section or directed by their immediate supervisor. For the purposes of this section, the duration of the Calamity Declaration shall be 24 hours unless activities are scheduled for that evening. Any employee(s) required to work shall be paid for the first two hours at one and one-half times the regular rate of pay. Hours in addition to the first two shall be paid at straight time. An early dismissal that does not reduce the time in school below the requirements for the minimum school day will not be considered to constitute a calamity. Bargaining Unit Members will be paid for calamity days. However, if the number of calamity days exceed five, Bargaining Unit Members who are scheduled to work less than 260 days will be required to work make up days at no additional pay. If an employee does not work on the makeup day, his/her pay will be docked for the calamity pay that was previously received for any such days unless a member has unused personal days, the member may elect to use their personal leave in lieu of working the regular contracted hours. In order to utilize personal leave on a calamity day, the employee must notify their immediate supervisor/administrator of the leave by 10:00am and put the leave in writing within 24 hours of the calamity day is called. 19.05 Employees those unit members who are required to work at times when school and are unable to report for work or who report after their regularly scheduled starting time (in no event later than 10:00 A.M., unless approved by the Superintendent) shall be permitted to use sick leave time, personal leave time, vacation time or leave without pay to account for the time missed from work.
2. Employees who are in a non-pay status before and after a calamity day will not be paid for the calamity day.
3. Employees are responsible for listening to the designated radio stations for the “calamity day” status.
4. The Employer has the right to waive unit member attendance due to non-weather related events.
5. If an employee is closed asked by the employer and agrees to work during a Level 3 Emergency, employee will be paid a compensated at their regular rate of pay unless: (a) for the day is one that the District is required calamity period, in addition to make up in order to complete the required school year as approved by the Board, and (b) the compensation for actual hours worked are hours for which at the employee is otherwise entitled to overtime compensationappropriate rate.
19.06 Employees who are required B. Because the part time nurse position is dependent upon the needs of the school program, this unit member will be expected to report for work when in accordance with information regarding whether or not the school is closed and who fail will be in operation on a given day.
C. Cancellation of programs or closing of facilities due to calamity will be governed by the following provisions:
1. If a Level 3 Emergency has been declared in Athens County or employee’s county of residence, which prevents employees from traveling on the roads, then employees will not be required to report will not receive any compensation for that day and may be subject to disciplinary action.

25.2 When an emergency exists and work is to be performed outside the regular work day, employees shall be called in to work based on the skill needed for the particular job and the availability of the employee to complete the work needed as determined by the supervisor.
25.3 It is the responsibility of the Director of Human Resources to notify the LSSA President, each employee on the list, and the sheriff’s department of all essential employees by September 15th of each school year. If the Fairfield County Sheriff has declared a Level Three Emergency, all employees not identified on the above list shall not be required to report to work.
25.4 When an announcement of a delay occurs, all bargaining unit members will adjust their arrival time by the amount of the delay (e.g. one hour, two hour), excluding maintenance, 1st shift custodians, food service (on delivery days) and bus mechanics who are directed by their supervisor to report otherwise. All bargaining unit members will receive their regular, contracted, number of hours of pay for the day at regardless of the number of hours actually worked, unless they are asked to work past their normal ending time. On a day which a delay occurs, maintenance, 1st shift custodians, food service (on delivery days) and bus mechanics who are required to report during the delay will be paid one- and one-half times their regular hourly rate for work they are called in to do for the equivalent amount of paythe delay. With supervisor approval, the employee may end their shift early (in the amount equivalent to the amount of the delay) in lieu of receiving overtime.
19.08 25.5 In the event that school is cancelled for students, any employee who is scheduled to report to work before 8:00 a.m. will be compensated for at least 30 minutes of work, provided that the time is worked. If an inclement weather delayemployee is directed or approved by his/her supervisor to remain at work, employees not listed in Article 19.02 whose day coincides with the start of employee will be paid for the student instructional day shall have a delayed report time equivalent to that of the delay, except for custodial/maintenance-grounds employees who shall report as directed by their supervisorhours worked.

19.03 Calamity day shall not include any day where the school building is closed to students due to an epidemic epidemic, weather conditions, or pandemic other public calamity, employees shall be paid for all hours contracted to work. A state emergency declared by the Governor of the State of Ohio or an extraordinarily grave event marked by great loss, lasting distress and student learning continues in affliction shall also be considered to be a remote or distance learning settingpublic calamity (the foregoing shall be referred to herein as “Calamity Days”).
19.04 Specific job duties or responsibilities may A. The administration of the Board reserves the right to require some any and all employees to report to work on Calamity Days. Any employee who is specifically required by the Superintendent to work on any of the first five (5) Calamity Days in a school year shall be granted compensatory time off in an amount equal to the hours actually worked on each such Calamity Day not to exceed the total number of hours in the instance of Level 2 snow emergenciesemployee's regular work day. 19.05 Employees who are required to work at times when school is closed will be paid a regular rate of pay unless: (a) the day is one that the District is required to make up in order to complete the required school year as approved by the Board, and (b) the hours worked are hours for which the employee is otherwise entitled to overtime compensation.
19.06 Employees who are required to report for work when school is closed and who fail to report will not receive any compensation for that day and may be subject to disciplinary action.
19.07 Non 12-month employees who are required to work on both a calamity day and a student make-up day scheduled by the Board without any additional compensation.
17.03 An annual in-service day shall be established in the calendar for all classified staff. If an initial Calamity Day is called the employees will be required to report as set forth in Sections 17.01 and 17.02. If that day will not be made up then the employee who was paid for working that day but did not work would be required to report to the makeannual in-up service day at that is established without pay. These employees who worked the Calamity Day would be paid their regular hourly rate daily rate. Additional Calamity Days are not subject to this Section. If the District does not call a Calamity Day during the school year then the scheduled in- service day will be an extra required paid day of paywork.

Should the actual hours worked on a calamity day cause a member to be on duty more than forty (40) hours in his/her assigned work when school is closed week, the member shall be paid time and who fail one-half (11/2) for all hours on duty over forty (40) hours. The Board shall be required to pay for actual time on duty for those members required to report will for duty on calamity days. The Board shall not receive any compensation be required to reimburse those members who reported for that day and may be subject duty without being requested to disciplinary action.
19.07 Non 12-month employees do so. The supervisor shall provide a work schedule for those members who are required to work report for duty on both a calamity day and a day. Calamity make-up day days will be paid scheduled and indicated on the school calendar. There will be four (4) days added to the end of the school calendar to be utilized as necessary for working the make-up day at their regular hourly rate of pay.

In addition to their regular pay as set forth in the preceding paragraphs, said employees shall be given compensatory time off at a rate of one day off (compensatory time) for one day worked. For all compensatory time earned, it must be used or paid within the same fiscal year earned. The utilization of said compensatory time off shall be subject to the approval of the immediate supervisor, principal, or Superintendent. No classified employee shall refuse to work on a calamity day if required to do so by the immediate supervisor, principal, or Superintendent. The employer shall institute a system to notify employees by phone when school has been delayed or cancelled. An employee who is closed will be determined by the Superintendent/designee in consultation with building not notified of a delay or cancellation and District administrators.
19.05 Employees who are required reports to work at times when school is closed will his/her regularly scheduled time shall be paid a two (2) hours show-up time in addition to his/her regular rate of pay unless: (a) calamity day pay. Employees in the day is one that the District is required to make up in order to complete the required school year as approved by the Board, and (b) the hours worked are hours for which the employee is otherwise entitled to overtime compensation.

19.04 Specific job duties or responsibilities may require some employees be required to report to work in unless they have duties to perform at schools that are not closed due to the instance calamity. Transportation services will be suspended to all schools served by the Bexley school buses on those days the Bexley Schools are closed by the Superintendent due to weather calamity. Where Bexley Schools are open but the schools to which the driver transports students are closed as a calamity day, the following rules apply:
A. The driver will be paid for the normal route time involved for the school(s) that was (were) closed.
B. The driver will be paid as non-calamity pay for hours driven for Bexley Schools on such days when Bexley is not closed.
C. All hours paid as calamity hours would count towards the calculation of Level 2 snow emergencies. The Superintendent/designee determines whether or overtime.
D. Pay for field trips driven for Bexley will be paid for a normal field trip rate and hours over forty (40) would be paid at time and a half per the Contract.
9.02 Those employees not conditions are too hazardous to expect employees required to report to work shall be paid their regular rate of pay for work at the regularly scheduled time, at a later time, or not at all. The work classifications and number of employees hours on such calamity days.
9.03 Employees required to work on a calamity day when school is closed shall be paid two and one- half times their regular rate of pay for hours worked on the calamity day. Thus, the employee will be paid his/her regular rate of pay as calamity day pay and time and one-half of his/her regular rate for hours actually worked on a calamity day. If the Sheriff has established a Level III emergency in Franklin County, employees will not be required to report unless specifically designated and legally able to do so. If an employee is absent because his/her county other than ▇▇▇▇▇▇▇▇ is under a Level III emergency but Bexley is open for school, the absence is excused and the employee may use available personal leave or vacation leave or be docked for the day; if Bexley is also closed on that day, Section 9.02 will apply.
9.04 Only that part of the day during which schools are declared closed shall be considered as a calamity day. Hours worked on that part of the day not considered as a calamity day will be paid at the employees regular rate of pay.
9.05 Employees not mentioned in 9.01 above (e.g., maintenance, custodial staff) shall work on a calamity day on an as needed basis as determined by the Superintendent/designee in consultation with building and District administratorsdesignee.
