Common use of By Owners of Benefitted Parcels Clause in Contracts

By Owners of Benefitted Parcels. No Owner shall use, nor permit any of its Tenants or any other person claiming use rights by or through such Owner to use, the Recreational Facilities Easement for any purpose or in any manner that, in the sole but reasonable judgment of the Owner of the burdened Parcel (subject, upon the request of any Owner who is denied the right to any use of the Recreational Facilities Easement pursuant to this Section 6(a), to Manager’s review pursuant to Section 2(c)), is either (i) likely to cause damage to the improvements within the Recreational Facilities Easement area, or (ii) inconsistent with such rules and regulations as the Owner of said burdened Parcel may, in its sole but reasonable judgment, from time to time deem necessary to assure the efficient, safe, and orderly use of its property (including without limitation commercially reasonable site security requirements).
