Declarant. “Declarant shall mean Lincoln Property Company, its successors and assigns. Declarant’s assigns shall be deemed to include any party whom Declarant designates, by means of a notice recorded in the Official Records of San Mateo County, as the party who, from and after the date such notice is recorded, will perform Declarant’s functions under this Declaration.
Declarant. Trendwest is the founder of the Club and the Declarant under the "Declaration of Vacation Owner Program (WorldMark, The Club)" ("Declaration") recorded for each Property annexed to the Club and dedicated to the Vacation Owner Program. Trendwest is also the Manager of the Club under a Management Agreement dated February 13, 1991.

Any certificate or voucher holder or a public housing authority on behalf of certificate or voucher holders shall have the right to seek judicial enforcement of this non-discrimination covenant in state or federal court.

Declarant. (i) applies for or consents to the appointment of, or the taking of possession by, a receiver, custodian, trustee, or liquidator of itself or of all of its property, (ii) admits in writing its inability, or is generally unable, to pay its debts as they become due, (iii) makes a general assignment for the benefit of its creditors, (iv) is adjudicated a bankrupt or insolvent, (v) commences a voluntary case under the Federal Bankruptcy Code, (vi) files a petition seeking to take advantage of any other law relating to bankruptcy, insolvency, reorganization, winding-up, or composition or adjustment of debts, (vii) fails to controvert in a timely and appropriate manner, or acquiesces in writing to, any petition filed against it in an involuntary case under the Bankruptcy Code, or (viii) takes any corporate action for the purpose of effecting any of the foregoing.
Declarant its heirs, assigns, and successors, hereby irrevocably assigns, transfers, and conveys unto ▇▇▇▇▇▇ County, Maryland, the ▇▇▇▇▇▇ County Housing Commission, and to Columbia Downtown Housing Corporation all of its right, title, interest, or obligation to enforce and maintain in full force and effect, the terms, conditions, and requirements of this Declaration of Covenants.
