Common use of By Orexigen Clause in Contracts

By Orexigen. During the Term and for [***] ([***]) years thereafter, Orexigen shall either (a) maintain, at its sole expense, clinical trial and product liability insurance relating to the Product that is comparable in type and amount to the insurance customarily maintained by Orexigen with respect to similar prescription pharmaceutical products that are marketed, distributed and sold in the Territory, or (b) self insure for such risks.
