Common use of Business Associate’s Agents Clause in Contracts

Business Associate’s Agents. Business Associate agrees to ensure that any officer, employee, contractor, subcontractor or agent to whom it provides PHI received from or maintained, created or received by Business Associate on behalf of Covered Entity agrees to the same restrictions and conditions that apply through this Agreement to Business Associate with respect to such PHI.

Business Associate’s Agents. Business Associate agrees to ensure that any officeragent, employeeincluding a subcontractor, contractorthat creates, subcontractor receives, maintains, or agent to whom it provides PHI received from transmits PHI, in electronic or maintainedother form, created or received by Business Associate on behalf of Covered Entity Business Associate agrees in writing to the same restrictions restrictions, terms and conditions that apply through this Agreement to Business Associate with respect to such PHIinformation.

Business Associate’s Agents. Business Associate agrees to shall ensure that any officeragent, employeeincluding a subcontractor, contractor, subcontractor or agent to whom it provides PHI received from from, or maintained, created or received by Business Associate on behalf of Covered Entity Entity, agrees to the same restrictions and conditions that apply through this Agreement to Business Associate with respect to such PHIinformation.

Business Associate represents that in the event of a disclosure of PHI to any third party, the information disclosed shall be no more than the minimum necessary for the intended purpose.
