Common use of Bulk Application Clause in Contracts

Bulk Application. If USL or USL’s agents make a bulk application for USL’s own account, on USL’s behalf and/or on behalf of USL’s other clients, the Client acknowledges and agrees: (a) that such bulk application may be rejected for reasons which are unrelated to the Client and the Client application and neither USL nor USL’s agent shall, in absence of fraud, negligence or willful default, be liable to the Client or any other person in consequence of such rejection; and (b) to indemnify USL if such bulk application is rejected either in circumstances where the representations and warranties have been breached or otherwise because of factors relating to the Client. The Client acknowledges that the Client may also be liable in damages to other persons affected by such breach or other factors.
