Breach Protocol Clause Samples
Breach Protocol. Upon becoming aware of any unlawful or unauthorized access to Student Data stored on equipment used by Contractor or in facilities used by Contractor, Contractor will take the following measures:
(a) promptly notify the District of the suspected or actual incident within a reasonable amount of time of the incident, not to exceed forty-eight hours, and shall present the information under the following headings: “What Happened,” “What Information was Involved,” “What We are Doing,” What You Can Do,” and “Persons to Contact for More Information”; and
(b) promptly investigate the incident and provide District with detailed information regarding the incident, including the identity of affected users; and
(c) and assist the District in notifying affected users, affected parents, legal guardians of commercially reasonable steps to mitigate the effects and to minimize any damage resulting from the incident. Upon request from District, Contractor shall reimburse District for actual costs associated with notifying affected parties.

Upon request from District, Contractor shall reimburse BUSD for actual costs associated with notifying affected parties. Indemnification. CONTRACTOR WILL DEFEND, INDEMNIFY AND HOLD BUSD AND ITS RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS, HARMLESS FROM AND AGAINST ANY AND ALL CLAIMS, SUITS, CAUSES OF ACTION, LIABILITY, LOSS, COSTS AND DAMAGES, INCLUDING REASONABLE ATTORNEY FEES, ARISING OUT OF OR RELATING TO ANY THIRD-PARTY CLAIM ARISING FROM BREACH BY CONTRACTOR OF ITS OBLIGATIONS IN THIS DPA, EXCEPT TO THE EXTENT RESULTING FROM THE ACTS OR OMISSIONS OF ED TECH JPA.
Breach Protocol.
12.1 In the event of a breach, where a breach is an unauthorized use or disclosure of Personal Health Information, the Participating Physician is responsible for promptly taking reasonable steps to contain the breach, investigate and analyze the breach, notify the appropriate people or organizations of the breach, and take steps to prevent a recurrence of the event.
12.2 The Office of the Information and Privacy Commissioner must be notified when there is a Material Breach of Personal Health Information.
12.3 If the Participating Physician suspects or finds a Material Breach in Med Access, the Participating Physician will promptly notify the NLCHI Service Desk of such suspected or actual breach. Service Desk coordinates are: 709.752.6006 or ▇▇▇▇▇▇▇.▇▇▇▇@▇▇▇▇▇.▇▇.▇▇ .
12.4 If the Participating Physician suspects or finds any breach, the Participating Physician is encouraged to notify the NLCHI Service Desk ▇-▇▇▇-▇▇▇-▇▇▇▇.
12.5 The Participating Physician shall consult the Office of the Information and Privacy Commissioner, the Physician Privacy and Security Manual or the NLCHI Service Desk if they require additional advice on the management of a breach.

Breach Protocol. 11.1 Within one (1) year of the establishment of the Management Committee, it shall develop a protocol document outlining procedures to be followed if there is a breach of this Schedule by any person, in accordance with the following principles:
(a) Breaches shall be reported to the Management Committee as soon as practicable; and
(b) The Management Committee shall decide what action it shall take in relation to a breach in accordance with the terms of the protocol which may include providing a recommendation to either the Githabul Corporation or DEC to take certain action.
11.2 The Management Committee shall consult with the Githabul Corporation about the protocol document and provide the final protocol document to the Githabul Corporation as soon as practicable after it has been adopted by the Management Committee.
11.3 The Githabul Corporation shall ensure the Githabul People are aware of the terms of the protocol document.
11.4 If any breach cannot be resolved in accordance with the protocol developed by the Management Committee, the provisions of clause 29 of this Agreement relating to dispute resolution shall apply.
11.5 If a Board of Management is established for any of the lands and waters in the National Parks, the protocol document may be amended from time to time by agreement between the Board of Management and the Githabul Corporation.
