Birds. Otay shall continue to implement bird control activities for birds that may be attracted to the Landfill, Such control activities may include the use of pyrotechnic or other means as may be necessary to control birds.
Birds. 26.1. On written application to the Trustees, only small, caged birds will be allowed subject to not more than two birds per cage and a maximum of one portable cage per Unit. 26.2. The Trustees must provide their written consent before an owner or occupier may keep a bird or birds in their unit. The Trustees may attach reasonable conditions to their consent. The owner must confirm acceptance of the conditions attached to the consent of the Trustees and must also undertake to comply with the provisions of these Conduct Rules. 26.3. Owners will be liable to pay for any damages caused by their birds. 26.4. Any bird being on the Estate in contravention of these rules shall be removed forthwith on notice from the Trustees and / or Managing Agent. 26.5. The Trustees may withdraw any consent if the owner or occupier of a Unit breaches any condition imposed or any of the rules above.
Birds. The Donkin peninsula is known to provide nesting, feeding and migratory habitat for approximately 300 bird species. In Canada, under the federal Migratory Bird Convention Act, migratory birds, their young, eggs and nests are protected and must be considered in an environmental assessment. This is in addition to the stipulations of ▇▇▇▇ referenced above. Together this legislation provides the mandate to recognize and address the importance of the peninsula to birds.
Birds. If Project activities will occur during nesting bird season (February 15 to September 15), the Qualified Biologist shall conduct focused surveys for active nests within five days prior to the initiation of Project-related activities. Surveys shall be conducted in all potential habitat located at, and adjacent to, Project work sites and in staging and storage areas. The minimum survey radii surrounding the work area shall be the following: (1) 250 feet for non-raptors; (2) and 1,000 feet for raptors. Survey methodology shall be submitted to CDFW by the Qualified Biologist for approval at least seven days prior to the initiation of surveys. Survey results shall be submitted to CDFW prior to the commencement of Project activities. If a lapse in Project-related activities of seven days or longer occurs, another focused survey will be required before Project activities can resume. If an active nest is found, Permittee shall consult with CDFW regarding appropriate action to comply with the Fish and Game Code of California. CDFW reserves the right to provide additional provisions to this Agreement designed to protect nesting birds.

  • Dogs 6.1. The Tenant shall not bring or cause to be brought onto the Allotment Site a dog unless it is held at all times on a leash, and remains on the Tenant’s Allotment Garden only. Any faeces to be removed and disposed of off site by the Tenant.

  • Animals The Hirer shall ensure that no animals (including birds) except guide dogs are brought into the premises, other than for a special event agreed to by the Village Hall. No animals whatsoever are to enter the kitchen at any time.

  • Dewatering (a) Where the whole of a site is so affected by surface water following a period of rain that all productive work is suspended by agreement of the Parties, then dewatering shall proceed as above with Employees so engaged being paid at penalty rates as is the case for safety rectification work. This work is typically performed by Employees engaged within CW1, CW2 or CW3 classifications. When other Employees are undertaking productive work in an area or areas not so affected then dewatering will only attract single time rates. (b) Where a part of a site is affected by surface water following a period of rain, thus rendering some areas unsafe for productive work, consistent with the Employer’s obligations under the OH&S Act, appropriate Employees shall assist in the tidying up of their own work site or area if it is so affected. Where required, appropriate Employees will be provided with the appropriate PPE. Such work to be paid at single time rates. Productive work will continue in areas not so affected. (c) To avoid any confusion any ‘dewatering’ time which prevents an Employee from being engaged in their normal productive work is not included in any calculation for the purposes of determining whether an Employee is entitled to go home due to wet weather (refer clauses 32.4 and 32.5)
