Bilateral Sales. Nothing in this Agreement shall be read to prohibit bilateral sales by Seller for electric energy, capacity, or ancillary services produced by the Bid Facility. Tier-1 eligible electric energy from the Bid Facility sold on a bilateral basis will produce Tier-1 RECs and NYSERDA will purchase such Tier-1 RECs in accordance with Article II of this Agreement, provided that the energy is delivered and sold into the NYCA in accordance with this Article.
