BFA Sample Clauses
The BFA (Best and Final Offer) clause defines the process by which parties submit their final, most competitive proposals during a negotiation or bidding process. Typically, after initial rounds of negotiation or tendering, the BFA clause requires all participants to present their last and best terms, often under a set deadline and with no further opportunity for revision. This clause ensures that the selection process is fair and transparent, compelling parties to put forward their most favorable terms and helping the decision-maker choose the optimal offer without prolonged negotiations.
BFA. BFA shall not be obligated under this Agreement to take any action or omit to take any action that it believes, in good faith, would cause it to be in violation of any applicable domestic or foreign anti-bribery or anti-corruption Laws.
