Basic Programs Clause Samples
The "Basic Programs" clause defines the fundamental services or offerings that a party is obligated to provide under the agreement. Typically, this clause outlines the scope, nature, and essential features of the programs, such as educational courses, software packages, or subscription services, that form the core of the contractual relationship. For example, it may specify the types of programs included, their duration, and any minimum standards they must meet. The primary function of this clause is to clearly establish what constitutes the basic deliverables, ensuring both parties have a mutual understanding of the essential services to be provided and reducing the risk of disputes over what is included.
Basic Programs. 17.1.1 On an ongoing basis, the District and the Association shall maintain a joint committee to review health benefits with the goal of cost containment.
17.1.2 The District will provide health insurance for all employees and their dependents. By September 1st of each year employees will select one of the agreed upon offered plans specified in Appendix C.
17.1.2.1 The District will cover the cost of the existing Plan C (Medical, Incentive Dental, Vision and Life Insurance) for the 2017-18 and the 2018-19 school years. Therefore, effective for the 2017-2018 school year, the District will contribute thirteen thousand twenty seven dollars and twenty cents ($13,027.20) per employee, for health and welfare premiums of bargaining unit members. Effective for the 2018-2019 school year, the District will increase the cap to cover the cost of the existing Plan C (Medical, Incentive Dental, Vision and Life Insurance). Any amount required for premiums to maintain the coverage provided by this article in excess of district contributions shall be paid by the unit member through withholdings from his or her monthly paycheck.
17.1.3 The District will provide vision insurance coverage for all employees and their eligible dependents under a plan identified on Appendix C.
17.1.4 The District will provide Dental insurance coverage for all employees and their eligible dependents under a plan identified on Appendix C.
17.1.5 The orthodontia coverage provided through Delta Dental Plan or Delta Dental Preferred Option can be reviewed on Appendix C.
17.1.6 The District will provide prescription drug coverage under a plan identified on Appendix C.
17.1.7 The District will provide a $70,000 term life insurance.
17.1.8 Unit members may use the District's IRC 125 plan, at District expense, only for the cost of health and welfare premiums paid by payroll deduction.
Basic Programs a. Teachers at the secondary level in academic areas shall have no more than five teaching periods, a preparation period, a lunch period and a duty period per day.*
b. Teachers in nonacademic areas shall teach no more than six periods per day and shall have a preparation period and a lunch period.*
c. Effective September 1, 1994, special subject teachers at the middle school level, except library teachers, shall be assigned to a teaching program consisting of no more than five teaching periods. Effective September 1, 1995, special subject teachers at the senior high school level, except library teachers, shall be assigned to a teaching program consisting of no more than five teaching periods. Therefore, on the appropriate effective date, teachers covered by this provision shall have the same basic program as in “a” above. *See Reference Article VII A. 1. - Nine Period Day
d. Secondary teachers may be assigned to a homeroom period in addition to their regular program. No teacher with six instructional periods shall be assigned to a homeroom duty unless he/she expresses a preference for such duty or unless there are not enough teachers with fewer than six periods (exclusive of those whose programs exempt them from homeroom duty) to staff the homerooms. Involuntary assignments to homeroom duty of teachers with six instructional periods shall be rotated annually.
e. Wherever possible, teachers new to the district and all teachers of English and of Social Studies shall have no more than two preparations per day unless otherwise voluntarily requested by the teacher. It is agreed that new curriculum additions and/or electives shall be exempt from the foregoing except that the Building Principal shall make reasonable efforts to provide two preparations in instances where facilities and scheduling permit.
Basic Programs. 7.1.1 The Board shall work with "School Employees Trust — Tulare County (SET-TC) SISC III to provide Health Benefits. In the event the above vendor is not used both parties agree to renegotiate this section of the contract.
7.1.2 The Board shall provide all full-time or part-time (Part time is defined as working six [6] hours or more per day, but less than eight [8] hours) Unit Members and their eligible dependents with a Basic Benefit Program.
7.1.3 For the 2024-2025 insurance plan year, the District will support the cost of Employee Benefit Plan and Life Insurance at a funded amount of $1,437.13 a month.
Basic Programs. In the event that the New Program is a Basic Program, to the extent that the Parties agree in writing to the concept and the proposed product configuration terms of such Basic Program, within ten (10) Business Days following the date on which all Parties provided such written agreement, or such other period of time as mutually agreed to in writing by the applicable Parties, FMER and/or FMC shall provide to SunTrust a written proposal containing a good faith estimate of the number of hours and cost associated with the design, development, and implementation of a Basic Program, and an invoice schedule (each proposal, a “Basic Program Proposal”). Following SunTrust’s receipt of a Basic Program Proposal, the Parties shall enter into good faith discussions to determine whether the Basic Program Proposal, including any changes to such Basic Program Proposal that may be negotiated among the Parties, is mutual acceptable to the Parties and, if the Basic Program Proposal is mutually acceptable, to begin development work on implementation of the New Program. Such good faith discussions shall not exceed ten (10) Business Days from the date on which SunTrust first receives the Basic Program Proposal. The Parties shall use good faith efforts to implement such Basic Program in accordance with the good faith estimates set forth in the Basic Program Proposal, as such Basic Program Proposal may be amended by the good faith discussions among the Parties. SunTrust shall pay FMER the final amount due in connection with each Basic Program in accordance with Section 6.9 of this Agreement.
Basic Programs. 1. The certificated benefit plan consists of the following: 80 – E $20.00 with the prescription plan of $9.00 for generic & $35.00 for brand names with a monthly premium of $1,215.60 for the 2015-2016 benefit year (October - September).
2. The District may fully fund the premium outlined in A.1 above for the 2016/2017 school year as part of the total compensation increase for the 2016/2017 year of 3.0%.
3. This Article shall be subject to a reopener for the 2017/2018 year.
