Bailee Waivers. Within sixty (60) days of the Closing Date (or such later date approved by Administrative Agent), the Borrower shall use commercially reasonable efforts to obtain and deliver to Administrative Agent a bailee waiver for each location for which a bailee arrangement is in place, which agreements shall be reasonably satisfactory in form and substance to Administrative Agent.

Bailee Waivers. If any Inventory of any of the Borrowers or any of their Subsidiaries is located in a public warehouse or other facility under the control of a third Person, each such Person shall have executed a bailee waiver or entered into other appropriate arrangements that are satisfactory to the Agent.

  • Severability; Waivers If any part of this Agreement is not enforceable, the rest of the Agreement may be enforced. The Bank retains all rights, even if it makes a loan after default.
