Common use of Available Procedure Clause in Contracts

Available Procedure. This negotiated grievance procedure will be the only procedure available to bargaining unit employees or the Parties for the processing and disposition of grievances as defined in Section 2 of this Article, an employees may choose a statutory appeal process or the negotiated grievance procedure but not both concerning matters for which a statutory choice of procedure exists. The Parties agree that a choice on any given matter is made when the grievance or appeal is formally filed in writing with the appropriate Management official for grievances and the appropriate authority for statutory appeals.
