Common use of AVAILABILITY OF PHI Clause in Contracts

AVAILABILITY OF PHI. Business Associate will make all PHI available to Covered Entity and otherwise cooperate with Covered Entity to the extent necessary for Covered Entity to comply with its obligations under 45 C.F.R. Sections 164.524-528, including providing patients access to medical records, an opportunity to amend incorrect information and an accounting of disclosures of PHI. Business Associate further agrees to make its internal practices, books and records, including policies and procedures and Confidential Information, relating to the use and disclosure of PHI available to the Secretary of Health and Human Services in a time and manner designated by the Secretary of Health and Human Services, if necessary, for the purpose of determining Covered Entity's compliance with HIPAA.
