Common use of AUTOMATIC RESIGNATION Clause in Contracts

AUTOMATIC RESIGNATION. Absence without leave for five consecutive working days shall be deemed an automatic resignation from County service, as of the last date on which the employee worked. Within fifteen (15) days after receipt of the service of notice of automatic termination, an employee may request reinstatement to the employee's previously held position. Reinstatement may be granted only if: a. The employee makes satisfactory explanation to the appointing authority as to the cause of the employee's absence or failure to obtain leave therefore, and the appointing authority determines that the employee is ready, able and willing to resume the discharge of the duties of his or her position; or b. The appointing authority consents to a leave of absence to commence upon reinstatement.
