Authorized Transmission Agent. Provider acknowledges that Google may use, and such use shall be permitted hereunder, Akamai Technologies, Inc., Limelight Networks, Level3 Communications or a similarly capable Google content delivery network (“Authorized Transmission Agent”) in the delivery of the Provider Content to users of the Google Services and/or YouTube Service; provided that, under no circumstances shall Google shall be liable for any damages caused by a third party Authorized Transmission Agent’s failure to comply with the applicable content security rules set forth in this Agreement., unless such Authorized Transmission Agent’s failure (i) is directly due to Google, and (ii) results in a third party’s authorized access to Provider Content.
