AuthorityoftheEngineer-in-charge. Thecontractorshallexecute,completeandmaintainthe worksinstrictaccordancewith the contractunderthe directionsandtotheentiresatisfactionoftheEngineer-In- Charge and shall comply with and adhere strictly to the Engineer-In-Charge's instructions,anddirectionsonanymatter(whethermentioned inthecontract ornot pertainingtothisworks) TheEngineer-In-Charge shalldecideallquestionswhichmayariseas toqualityand acceptability ofmaterials furnished and work executed,mannerofexecution,rate of progressoftheworks,interpretation of the plansandspecifications andacceptabilityof fulfillmentofthe contractoronthepart ofthe contractor.Heshalldeterminethe amountandqualityoftheworkperformedandmaterialsfurnishedandhis decisionand measurementsshallbefinal.Inallsuchmattersandinanytechnicalquestionswhich mayarisetouchingthecontract,his decisionshallbebindingonthecontractor.The Engineer-in-charge shallhave thepowertoenforce such decision andorders ifthe contractorfailsto carrythemout promptly.Ifthecontractorfailsto executethework ordered by the Engineer-in-charge may givenotice tothe contractorspecifying a reasonableperiodtherein andontheexpiryofthe periodproceedto executesuchwork asmaybedeemednecessaryandrecoverthecostthereoffromthecontractor. Incaseofanyconflict withinthespecifications,conditionsintheTenderDocument,the contractorshallbring into noticeofEngineer-in-chargeimmediatelywhose decisionin that regardwillbefinal.
