Common use of Assistance to the Department Clause in Contracts

Assistance to the Department. The Provider must: give full, true and particular information, in respect of any proposal for a policy of insurance (including any policy issued pursuant to any self-insurance scheme of the Commonwealth) to be effected by the Department, of all matters and things the non-disclosure of which might in any way prejudice or affect any policy or the payments of all or any benefits under a policy; and provide all reasonable assistance to the Department, in order to facilitate the Commonwealth making a claim under any insurance policy or self-insurance scheme effected for the Commonwealth’s benefit. For the avoidance of doubt, the provisions of this clause 49 are not to be read so as to reduce a Party’s liability under any other provision of this Agreement, and compliance by the Provider with the provisions of this clause 49 does not limit its liability under any other provision of this Agreement.
