ASSIGNING AND TRANSFERRING. The provisions of this Section are subject to, and subordinate to the limitations of Article V of this Lease entitled "USE, OPERATION, and MAINTENANCE AND CONDITION OF LEASED PREMISES”.

ASSIGNING AND TRANSFERRING. LICENSEE understands that this License is not an interest in real property nor is it an assignable right. Any attempt to assign or otherwise transfer this License by LICENSEE, voluntarily or by operation of law, shall automatically terminate this License. If LICENSEE hereunder is a corporation, an unincorporated association, limited liability company, limited liability partnership, limited partnership, or partnership, the Encumbrance of any stock or interest in said corporation, association, limited liability company, limited liability partnership, limited partnership or partnership in the aggregate exceeding fifty-one percent (51%) shall be deemed an assignment within the meaning of this Section.
