Common use of Arbitrator Panel Clause in Contracts

Arbitrator Panel. Both parties shall mutually agree on panel members to fill a three-member arbitration panel when arbitration is needed to resolve a grievance or decide on a contract dispute for the life of the Agreement. If the parties are unable to agree upon any of the three members, then a list of seven (7) arbitrators shall be mutually requested from the American Arbitration Association or SERB and the parties shall use the alternate strike method to select an arbitrator to fill the vacant position on the panel. Either party may choose to terminate an arbitrator from the panel with reasonable notice to the other party. In the event that either of the parties exercises the right to terminate an arbitrator on the panel, a replacement shall be selected pursuant to the procedure in the previous paragraph.
