Application of Article. This Article is intended only as a basis of calculating overtime payments, and nothing in this Agreement shall be construed as a guarantee of hours of work per day, week, tour of duty, work period or year.
Application of Article. The provisions of this Article shall apply to all Full Time Regular Employees but shall not apply with respect to Full Time Temporary Employees.

In the event that any amount or benefit paid or distributed to Executive pursuant to this Agreement, taken together with any amounts or benefits otherwise paid or distributed to Executive by the Company or any affiliated company (collectively, the "Covered Payments"), would be an "excess parachute payment" as defined in Section 280G of the Code and would thereby subject Executive to the tax (the "Excise Tax") imposed under Section 4999 of the Code (or any similar tax that may hereafter be imposed), the provisions of this Article 4 shall apply to determine the amounts payable to Executive pursuant to this Agreement.
Application of Article. The first twelve (12) calendar months of initial Department employment will serve as the attorney’s trial service period. This time shall be considered an extension of the hiring process. Trial service employees may be removed without cause and such decision is not subject to the grievance/arbitration procedure or Employment Relations Board review. After successfully completion of the trial service period, employees may be disciplined as set forth below.
Application of Article. This Article shall apply if Supplier's activities within Delaware create a substantial exposure to the Company as to the recovery of costs incurred by the Company to deliver services to the Customer, specifically including, but not limited to, the circumstance where a Supplier provides consolidated billing services for its own charges and the Company's charges. In such circumstance where this Article shall apply to such Supplier, the Credit Amount shall be as defined in Article 1. This Article shall be applied in a non- discriminatory manner both in terms of when the Article applies and the method by which Creditworthiness maybe established and maintained.
