In the case where the last shift worked is such a day or time event that the Employee cannot get parties are unable to reach agreement as to the timing of annual leave, the employer may require the employee to take annual leave by giving 28 days written notice.
(g) At the beginning of any twelve month period an employee may elect to take a bank during business hours, then payment shall be made one 2% salary reduction in return for an additional weeks leave on full pay at the end of that twelve month period.

Annual Holidays. 12:01 All Employees 2.1 Annual holidays shall receive Annual Vacations be allowed in accordance with the following: For Holidays Act 2003 and its amendments. Annual Holidays. 12:01 All Employees 9.2.1 Annual holidays shall receive Annual Vacations be four weeks at the end of each year of service in accordance with the following: Holidays Act 2003.
9.2.2 The employer shall allow employees at least two uninterrupted weeks annual leave (wholly or partly in advance by mutual agreement [subject to refund on resignation if necessary]) commencing within six months after the anniversary date of entitlement, and any balance shall be allowed within 12 months after the anniversary date.
9.2.3 The time in which annual leave entitlement may be taken shall be fixed by the employer after consultation with the employee, and in fixing that time work requirements and available rest and recreation opportunities for the employee shall be taken into account. Any unused entitlement shall be carried forward.
9.2.4 Employees who work rotating shift patterns or those who work qualifying shifts shall be entitled, on completion of 12 months employment on shift work, to up to an additional 5 days annual leave, based on the number of qualifying shifts worked. The entitlement will be calculated on the annual leave anniversary date. Qualifying shifts are defined as a shift that involves at least 2 hours work performed outside the hours of 8.00am - 5.00pm, excluding overtime, except for theatre employees who work overtime after 7pm.
9.2.5 Upon completion of five years' current continuous service with the employer, employees shall be entitled to an annual holiday of five weeks instead of four pursuant to subclause 9.2.1.
9.2.6 The fifth week's holiday may be taken in conjunction with or separately from the first four weeks as may be mutually agreed upon, or failing such agreement as the employer may decide.
9.2.7 For the purpose avoidance of determining an Employees vacation entitlement and vacation paydoubt, the Employee's Anniversary Date no employee shall be used. The Employee shall take the vacation on or after the Anniversary Date except when mutually agreed between Employer and Employee in writingentitled to more than six weeks annual leave per year.
12:02 9.2.8 The Employer shall provide parties to this collective agreement agree that the taking of a minimum of 4 weeks paid annual leave per 12 months of employment is essential for the rest and recreation needs of all employees. As per the terms of the Holidays Act 2003 an employee may request the employer pay out a portion of the employee's entitlement to annual holidays. A request must be in writing and may be made on 1 or more separate occasions until a maximum of 1 week of the employee's annual holidays is paid out in each Employee at entitlement year. If an employee makes a request the beginning of each year employer must—
(a) consider the request within a Vacation Request Form. The Employee shall have ninety days reasonable time; and
(January 1 - March 31b) advise the employee in writing as to complete whether the form and to return it employer agrees to the Employer. (e) Annual leave may be taken in advance by agreement with the Employee going on vacationemployer and will be available to employees in their first 12 months of service. Such agreement shall not be unreasonably be withheld. The parties agree that any VXFK KROLGD\ SD\ SDLG LQ DGYDQFH PD\ EH G she/he leaves the service before the leave has lawfully been accrued.
(f) Study leave and annual leave shall be taken at times mutually agreed between the worker and the employer. The worker is required to give reasonable notice of any application of leave. In the case where the last shift worked is such a day or time event that the Employee cannot get parties are unable to reach agreement as to the timing of annual leave, the employer may require the employee to take annual leave by giving 28 days written notice.
(g) At the beginning of any twelve month period an employee may elect to take a bank during business hours, then payment shall be made one 2% salary reduction in return for an additional weeks leave on full pay at the end of that twelve month period.
