Common use of Annual Financial Information Clause in Contracts

Annual Financial Information. Subject to the Manager receiving all necessary information from third parties, within ninety (90) days after the end of each fiscal year of the Fund, the Manager shall send to each Person who was a Member in the Fund at any time during the fiscal year then ended an internally prepared, audited statement of assets, liabilities and Members’ capital as of the end of such fiscal year and related statements of income or loss and changes in assets, liabilities and Members’ capital.

Subject to the Manager receiving all necessary information from third parties, within ninety (90) days after the end of each fiscal year of the FundCompany, the Manager shall send (with email transmission being expressly permitted with respect to such statements) to each Person who was a Member in the Fund Company at any time during the fiscal year then ended an internally prepared, audited statement of assets, liabilities and Members’ ' capital as of the end of such fiscal year and related statements of income or loss and changes in assets, liabilities and Members’ ' capital.
