Common use of AMBIT OF THE BANK’S DUTIES AND RESPONSIBILITIES Clause in Contracts

AMBIT OF THE BANK’S DUTIES AND RESPONSIBILITIES. (a) The Bank, pursuant to Instructions given by the Customer, may subscribe or apply for Securities on the Customer’s behalf upon any issue or offer to the public notwithstanding that the Bank or any of its Affiliates is participating in the underwriting or making of such issue or offer or otherwise acting in connection therewith.
