Alternative Assignment Clause Samples
The Alternative Assignment clause allows one party to fulfill its contractual obligations by providing a substitute performance or deliverable instead of the originally specified one. In practice, this might mean delivering a different product, service, or resource if the original cannot be provided, often subject to the other party's approval or certain predefined conditions. This clause provides flexibility in contract execution, helping to ensure that obligations can still be met even if unforeseen circumstances prevent the original assignment, thereby reducing the risk of breach and maintaining the continuity of the agreement.
Alternative Assignment. In the event that an employee becomes incapable of performing the duties of his/her regular classification through occupational illness or industrial accident, the employer may transfer the employee without loss of pay to a position for which he/she is qualified provided the change can be accomplished without displacing another employee.
Alternative Assignment. Immediately following the completion of a probationary period that does not produce performance improvement detailed in the Probationary Plan of Improvement, the probationary employee may be removed from their assignment and placed into an alternative assignment for the remainder of the year. This reassignment may not displace another employee, nor may it adversely affect the probationary employee’s compensation or benefits for the remainder of the probationary employee’s contract year. If such a reassignment is not possible, the District may, at its option, place the probationary employee on paid leave for the balance of the contract term.
Alternative Assignment. Under normal circumstances, a class should be con- ducted from beginning to end by a single instructor. Leaves taken under this article have the potential of disrupting classes, since more than one instructor will teach the classes. In order to keep this disruption to a minimum, Western may deem it wise not to return the faculty member to the classroom for the conclusion of the semester in which a leave is taken. In these cases Western may require the faculty member to transfer temporarily to an alternative position, offered by Western, for which the member is qualified and which has equivalent pay and benefits.

Alternative Assignment. The goal of teachers is to instruct their students and assess their level of mastery of the material in the curriculum. If a student violates the Academic Honor Code, then there has not been a valid assessment of a student’s level of learning. Teachers are justified in asking for a demonstration of a student’s level of mastery of work before proceeding further into the curriculum . The alternative assignment is not punitive in nature; rather, it is used to determine the level of mastery of the curriculum material.
Alternative Assignment. An employee placed on an alternative assignment during an investigation will not be prohibited from contacting their union ▇▇▇▇▇▇▇ unless there is a conflict of interest, in which case the employee may contact another union ▇▇▇▇▇▇▇. This does not preclude the Employer from restricting an employee’s access to the Employer’s premises.
Alternative Assignment. Immediately following the completion of the probationary period that does not produce necessary performance changes detailed in the initial notice of deficiencies and program for improvement, a certified classroom teacher may be removed from his or her assignment and placed into an alternative assignment for the remainder of the school year. A certificated classroom teacher may be removed from his or her assignment and placed into an alternative assignment for the remainder of the school year immediately following the completion of a probationary period that does not result in the required comprehensive summative evaluation performance rating of Level 2 or above for a provisional employee or a continuing contract employee with five or fewer years of experience or of Level 3 or above for a continuing contract employee with more than five (5) years of experience. The alternative assignment may not displace another staff member or adversely affect the certified classroom teacher’s/certificated support personnel’s compensation or benefits for the remainder of the contract year. In the event such alternative assignment is not possible, the district may place the staff person on paid leave for the balance of the contract term.
Alternative Assignment a. In order to replace a confirmed pre-cancellation, Crew Scheduling will place a pre-cancellation placeholder on the Lineholder’s line of time in Crew Access that allows for pick up over the footprint of the original sequence plus two hours (2:00) earlier and later (“pre-cancellation pick up footprint”) per 10.S.10., below. Crew Scheduling may also offer the Lineholder an alternative assignment that may include alteration of the original sequence and/or multiple sequences on the same day(s) as the original sequence containing the pre-cancellation.
b. If an alternative assignment is accepted, the duty period commences at the report time of the alternative assignment.
c. If the original sequence is a Premium Open Time sequence, that premium will apply to the alternative assignment. If a Lineholder subsequently trades such assignment the premium will be subject to adjustment pursuant to the provisions of Section 9.E.3. [Trading/Giving Away Premium OT].
d. In the case of co-terminals, if the alternative assignment does not check-in and release at the same co- terminal as the pre-cancelled flights, and the Lineholder did not pick up pursuant to 10.S.10, the Company will pay-protect any difference in flying pursuant to Section 21.M. [Pay Protection…] and at the Lineholder’s request, the Company will provide surface deadhead transportation to and from the co- terminal of the original assignment and the domicile/co-terminal of the alternative assignment.
e. In the case of Severe Irregular Operations (SIO), the Lineholder may pick up per 2.a., above, and will receive the greater of the premium posted on the sequence, or one and one-half times (1.5x) the trip rate on flights flown, including surface deadhead.
