All D. E.C.E.’s covered by this Collective Agreement shall, as a condition of employment, maintain membership in ETFO and be required to pay union dues and assessments chargeable by ETFO.

All D. E.C.E.s who are transferred as a result of staffing re-organization to an existing classroom in September shall be entitled to be notified at least two (2) school days in advance of the transfer. All D.E.C.E.s transferred as a result of staffing re-organization may request a half day to relocate into the existing classroom. The request shall not be unreasonably denied (a) After consultation with the surplus D.E.C.E., the Board shall assign that D.E.C.E. to any available vacancy with the same number of hours prior to the Board hiring any new D.E.C.E.s. In the event that the same vacancy is claimed by two or more surplus D.E.C.E.s, it shall be assigned to the D.E.C.E. with the greatest seniority. In the event there is no vacancy to which the surplus D.E.C.E. can be assigned, t h e D.E.C.E. shall be issued a layo ff notice in accordance with the notice provisions of the Employment Standards Act.
