Advisory Panel. In the event an agreement is not reached by negotiation after full consideration of proposals and counter-proposals, either of the parties shall have the option of declaring impasse, and thereby creating an Advisory Panel of three (3) persons within ten (10) days of said declaration. One member shall be designated by the Board, one member by the recognized classified employee organization, and these shall select a third person. The third person, who shall act as chairperson, shall be named by the first two appointed members. If the two cannot agree on the third, the third person shall be selected from the list or lists of arbitrators from the American Arbitration Associations in accordance with their voluntary rules and regulations. The Advisory Panel shall act as fact-finders, conferring with both parties and making recommendations for settlement of the issue(s) in question. Each party will pay the expenses of its own representative on the Advisory Panel. However, the expenses of the chairman will be shared equally by the Board and the recognized classified employee organization. The recommendations of the Advisory Panel shall be submitted to the negotiators for consideration. If agreement is not reached within ten (10) days, or a mutually agreed upon date, it shall be submitted to the recognized classified employee organization for action and the Board for action within ten (10) days after being submitted. Said report shall be made public after the action of both parties. If the two parties agree on the panel’s recommendation for settlement, it shall be approved in accordance with Article VII Agreement.
