Neither the Company nor any Company Subsidiary has (i) granted access or rights to any of its Source Code in or for any Company Products to any third party; or (ii) licensed or granted a third party the right to obtain any of its Source Code in or for any Company Products (including in any such case, any conditional right to access, or under which the Company or any Company Subsidiary has established any escrow arrangement for the storage and conditional release of any Source Code).
