Common use of Access to PHI Clause in Contracts

Access to PHI. To the extent that Business Associate possesses an applicable Designated Record Set, and within a reasonable amount of time of receipt of a request from Covered Entity or Individual to access such PHI, Business Associate shall make available such PHI, to the extent required for Covered Entity’s compliance with its obligations under 45 C.F.R. §164.524.

Access to PHI. To At the extent that Business Associate possesses an applicable Designated Record Set, and within a reasonable amount request of time of receipt of a request from Covered Entity or Individual to access such PHIEntity, Business Associate shall make available such PHIprovide access to PHI in a Designated Record Set as directed by Covered Entity, to an Individual in order to meet the extent required for Covered Entity’s compliance with its obligations under requirements of 45 C.F.R. §§ 164.524. To the extent that Business Associate possesses an applicable maintains PHI in a Designated Record Set, and within to the extent that Business Associate maintains the key or has the ability to decrypt the PHI in a reasonable amount of time of receipt of a request from Covered Entity or Individual to access such PHIDesignated Record Set, Business Associate shall make such information available such PHIto the Covered Entity, and in the time and manner reasonably designated by Covered Entity, to Covered Entity in order to meet the extent required for Covered Entity’s compliance with its obligations requirements under 45 C.F.R. §CFR Section 164.524.
