Unfinished Projects definition

Unfinished Projects as of any date, any Project (a) with respect to which the Commencement of Construction has occurred prior to such date and (b) the Completion of Construction has not occurred; provided that the parties acknowledge and agree that Commencement of Construction has occurred for the River City Property Project prior to the Effective Date.

Examples of Unfinished Projects in a sentence

  • Within thirty (30) days prior to the expiration of this Agreement, if either party believes that it will be necessary for the Agreement to be extended to permit the performance or completion of any Unfinished Projects, such party shall give written notice thereof to the other party specifying the Unfinished Projects, the obligations thereunder that remain to be completed, and an estimate of the amount of time required for such completion.

  • Following such notice, the term of the Agreement shall be extended with respect to the Unfinished Project(s) identified therein to the extent necessary to complete the remaining unsatisfied obligations within the estimated time frame specified in such notice, unless within ten (10) days after receipt of such notice the recipient sends a written response to the other party noting any exceptions that it may have to the scope or term of the Unfinished Project.

  • The applicable Project shall satisfy the In-Balance Test if, as of such date, the Project Sources exceed the Project Uses for such Project (and for all other Unfinished Projects) for the Project Period for such Project.

  • Seller shall have the right to terminate this Agreement if, within one hundred twenty (120) days after the Effective Date, Seller has not received a commitment letter from a financing entity acceptable to Seller for the provision of non-recourse financing for the construction and operation of the Project on terms acceptable to Seller in its sole discretion, by providing notice to Buyer following the expiration of such 120-day period.

  • generating plant means the generating facility described in Schedule 1 as amended from time to time;

  • Approved Project means the project as described in the bound volume entitled ‘Project Description’ initialled by or on behalf of the Minister and the Company for the purpose of identification;

  • Production Area means that part of the animal feeding operation that includes the animal confinement area, the manure storage area, the raw materials storage area, and the waste containment areas. The animal confinement area includes, but is not limited to, open lots, housed lots, feedlots, confinement houses, stall barns, free stall barns, milkrooms, milking centers, egg washing or egg processing areas, areas used for the storage and disposal/treatment of mortalities, cowyards, barnyards, medication pens, walkers, animal walkways, and stables. The manure storage area includes, but is not limited to, lagoons, runoff ponds, storage sheds, stockpiles, under-house or pit storages, liquid impoundments, static piles, and composting piles. The raw materials storage area includes, but is not limited to, feed silos, and silage bunkers. The waste containment area includes, but is not limited to, settling basins and areas within berms and diversions which separate uncontaminated stormwater.

  • Project means the goods or Services described in the Signature Document or a Work Order of this Contract.

  • Projects means the projects identified in Exhibit A to the Agreement and all other projects, any costs of which are included in a Transitional Capital Plan pursuant to the Act or are Recovery Costs, and financed, by payment or reimbursement, with the proceeds of Bonds or Notes.
