As set forth in a Terminal Service Order, and subject to the other provisions set forth herein and the availability of suitable space at the Terminal, Customer shall have the option of having TLO install and maintain at the Terminal, at Customer’s sole risk, cost and expense, such special additive equipment as may be desirable for Products to be delivered to Customer’s account hereunder.
Upon request by Terminal, Customer shall provide to Terminal all certificates and license information as may be required in connection with the payment of or exemption from applicable fuel and excise taxes.
If Customer installs its own additive injection systems at the Terminal, Customer shall pay Company any related additive equipment fee pursuant to the Schedule.
In the event Customer installs its own additive equipment at the Terminal, Customer shall pay Company an additive equipment fee based on Company’s cost to operate the additive equipment plus a reasonable return to Company for the operation of such equipment.
As a condition to being granted access to the Terminal, Customer shall require all contractors, carriers and customers designated by it to deliver, receive, sample or inspect Customer’s Products at such Terminal, or to provide any other service for Customer, to sign and comply with the Terminal access agreement in such form as Company may reasonably specify from time to time.
To request a berth at Galena Park Terminal, Customer will give Magellan written notice that: (a) proposes a one (1) to three (3) day date range for loading or discharge of a specific Vessel at the Galena Park Terminal; (b) specifies the proposed Vessel's name, flag, deadweight tonnage, length, beam and draft and the volume and nature of cargo Customer intends to load or discharge; and (c) provides any additional information or documentation that Magellan reasonably requests.
If any of Customer's Commodity is sold, exchanged, or otherwise changes ownership while in the Terminal, Customer shall nonetheless be responsible for all charges, taxes, terms and conditions of this Agreement the same as if Commodity had been owned by Customer.
As applicable at the respective Terminal, Customer may not allow a Person to use any of its reserved capacity or transfer title of the Products to a Person while the Products are in such respective Terminal, without the prior written consent of Provider, which consent shall not be unreasonably conditioned, delayed or withheld.
