Upon TxDOT’s approval of Developer’s proposal and authorization for Developer to proceed with the agreed upon update, Developer shall provide TxDOT with an update to the Master Development Plan to account for recent developments in the Project due to environmental factors, economic financial factors, Governmental Approvals, relevant changes to the regional metropolitan plan, Risk Events, or other factors in accordance with the requirements of Exhibit D, item S and the approved Master Development Plan.
Agreement by the parties on the scope of and terms of Developer’s compensation for Technical Support Services related to the NEPA process and Update Work, including the terms of compensation for Developer’s unpaid costs for Update Work in the event of a Risk Event, shall be a condition to approval of the Master Development Plan.
