  • Nothing contained herein shall alter or affect the right of Soffe, consistent with applicable law, to alter or amend such plans at any time.

  • In the event Executive becomes "disabled" (as hereinafter defined), Soffe may terminate Executive's employment by delivering a written termination notice to Executive.

  • The parties hereto agree that the payments provided under Subsections 5(a) and (b) above are reasonable compensation in light of Executive's services rendered to Soffe and that neither party shall assert that the payment of such benefits constitutes an "excess parachute payment" within the meaning of Section 280G(b)(1) of the Code.

  • All Soffe Party Claims are forever barred by this Release whether they arise in contract or tort or under a statute or any other law.

  • Soffe may, at its option, purchase an insurance policy providing comparable coverage for the benefit of Executive to meet its obligations under this subsection for all or part of the period during which such obligation exists.
