  • The terms of such Series M Notes are herein incorporated by reference and are part of this Thirteenth Supplemental Indenture.

  • So long as any of the Series M Notes are outstanding, the Company will not create or suffer to be created or to exist any additional mortgage, pledge, security interest, or other lien (collectively “Liens”) on any of its utility properties or tangible assets now owned or hereafter acquired to secure any indebtedness for borrowed money (“Secured Debt”), without providing that the Series M Notes will be similarly secured.

  • The Company desires to create a series of the Senior Notes in an aggregate principal amount of $575,000,000 to be designated the “4.10% Senior Notes, Series M, due 2028” (the “Series M Notes”), and all action on the part of the Company necessary to authorize the issuance of the Series M Notes under the Original Indenture and this Thirteenth Supplemental Indenture has been duly taken.

  • Any such additional Series M Notes will have the same interest rate, maturity and other terms as those initially issued (other than the date of issuance, the issue price and, in some circumstances, the initial interest accrual date and initial interest payment date).

Related to Series M Notes

  • Class M Notes means any one of the Notes executed by the Owner Trustee, on behalf of the Issuer, and authenticated by or on behalf of the Indenture Trustee, substantially in the form of Exhibit A-2.

  • Class A-5 Notes means the $_________ Floating Rate Class A-5 Student Loan Asset-Backed Notes issued by the Trust pursuant to the Indenture, substantially in the form of Exhibit A thereto.
