Subject to the provisions of any Financing Agreements, all moneys received under asset insurance policies shall be promptly applied by QICT towards repair or renovation or restoration or substitution of the Project or any part thereof which may have been damaged or destroyed.

In the event that any damage is caused in part only due to the negligence or default or omission on the part of PQA and in part only due to the negligence or default or omission on the part of QICT, each Party shall be liable to the other Party only in proportion to its respective degree of negligence or default or omission as the case may be.
Subsequent to the establishment of electronic inter faces between QICT and PQA, QICT shall consult PQA before making any alteration in the software related to electronic flow of information to PQA.
With the exception of berths 5, 6, 7 and the Terminal QICT will not handle containers at other berths at Port Qasim, except with the express approval of PQA.
