Proceeding for Relief definition

Proceeding for Relief shall have the meaning set forth in Section 16.1(f) hereof.
Proceeding for Relief means any case, proceeding or other action seeking to have an order for relief entered on a party’s behalf as a debtor or to adjudicate it as bankrupt or insolvent, or seeking reorganization, arrangement, adjustment, liquidation, dissolution or composition of it or its debts or seeking appointment of a receiver, trustee, custodian or other similar official for it or for all or of any substantial part of its property.

Examples of Proceeding for Relief in a sentence

  • In the event Tenant (a) makes a general assignment for the benefit of creditors, (b) commences any Proceeding for Relief, (c) becomes the subject of any Proceeding for Relief which is not dismissed within ninety (90) days after its filing or entry, or (d) is dissolved or otherwise fails to maintain its legal existence.

  • Receivership court means the court in the insolvent or impaired insurer's state having jurisdiction over the conservation, rehabilitation, or liquidation of the member insurer.
