Examples of Pre-Petition Loans in a sentence
If the Debtor has paid the Post-Petition DIP Financing by the maturity date, the Debtor shall have a period not to exceed thirty-six (36) months from the Effective Date (the “Sellout Period”) in which to pay the claims arising from the Pre-Petition Loans.
In the event and on such occasion that any advance is made to the Borrower or any other Loan Party under the Qualifying DIP RE Facility, the Borrower shall, on the next Business Day, prepay first, the Pre-Petition Loans then outstanding (other than the Retained Pre-Petition Obligations except to the extent provided in Section 2.07(h)) in the order and manner provided in the Pre-Petition Credit Agreement and second, the Loans and/or LC Obligations in an aggregate principal amount equal to such advance.

If the aggregate amount of outstanding Revolving Loans, Pre-Petition Loans (other than the term loan under the Existing Credit Facilities) and Letter of Credit Exposure exceeds the Borrowing Base, then the portion of such outstanding amount of Revolving Loans in excess of the Borrowing Base (with Letter of Credit Exposure being deemed for these purposes to be within the Borrowing Base) shall bear interest at a rate per annum equal to the Regular Rate plus three percent (3.00%) for such day.
