Not later than [ ] months before the Certification Date and before each subsequent anniversary of the Certification Date (each a “Planned Maintenance Programme Submission Date”), PPP Co. will submit to the Authority’s Representative a draft Planned Maintenance Programme for the next Contract Year for agreement in accordance with the Review Procedure set out in Schedule 5 (Review Procedure).
Any revisions to the Planned Maintenance Programme other than in the case of an Emergency or works of a de minimis nature (“Unprogrammed Maintenance Work”) will also be agreed in accordance with the provisions of Schedule 5 (Review Procedure).
Each Planned Maintenance Programme will contain the following information: details of the proposed start and end dates for each period of Programmed Maintenance, the works to be carried out and the proposed hours of work; and details of any effect of the Programmed Maintenance on the delivery of any of the Services.
The Planned Maintenance Programme will be confirmed annually by the Governing Body and the Council.
At the end of each Contract Year and for each Project Facility, PPP Co. will supply to the Authority an account of any damage and associated Repair Costs and Damage Funding, as well as money spent or saved or to be spent or saved in accordance with the Planned Maintenance Programme.
If the Authority's Representative does not notify the Contractor's Representative within [insert number] Business Days pursuant to this Clause 28.3.1, the draft Planned Maintenance Programme shall be deemed to be the Planned Maintenance Programme.
