New Data means (a) a modified version of User Data or Customer Data or (b) new data created with reference to User Data or Customer Data, in each case whether through aggregation, cleansing, scrubbing, reverse engineering, extraction or other means, such that (i) with respect to modified User Data or new data created with reference thereto, the applicable User has been de-identified in accordance with 45 CFR section 164.514, as applicable and (ii) with respect to modified Customer Data or new data created with reference thereto, Customer has been de-identified in accordance with 45 CFR section 164.514, as applicable.

Examples of New Data in a sentence

  • Unless prohibited by law, you will promptly inform us of any request from a third party to exercise any purported rights with respect to the New Data.

  • You are responsible for proper security of any New Data you receive.

  • Any New Data is Confidential Information and joint proprietary data and shall be treated as such under this Agreement.

  • Any New Data generated or developed jointly by the Members in accordance with this Agreement shall be owned jointly by the Members provided that the individual Members have contributed to the costs thereof in accordance with this Agreement.

  • Affiliates of a Member shall have the same rights on Existing and New Data as the relevant Member to which they are affiliated and provided that such Member has contributed to the costs thereof in accordance with this Agreement.

  • Each of the joint owners shall obtain a full copy of the New Data.

  • AsŶbeŽtwƚee nŝyoŶu aĐndůuƵs, ĚweĞo wn and retain all rights, title and interest in and to the New Data, and you may use New Data only for your lawful, internal cybersecurity analysis/auditing purposes in accordance with this Agreement.

Related to New Data

  • GLO Data means any data or information owned by the GLO, including PII or SPI as defined below, that Provider creates, obtains, accesses (via records, systems, or otherwise), receives (from the GLO or on behalf of the GLO), or uses in the performance of the Contract or any documents related thereto.

  • Vendor Data means any and all information, data and documentation to be provided by Subcontractor and any of its lower-tier Subcontractors under this Subcontract.

  • Regulatory Data means any and all research data, pharmacology data, chemistry, manufacturing, and control data, preclinical data, clinical data or all other documentation submitted, or required to be submitted, to Regulatory Authorities in association with regulatory filings for the Product in the Field (including any Drug Master Files (DMFs), Chemistry, Manufacturing and Control (“CMC”) data, or similar documentation).

  • End User Data means any information or data of any kind that personally identifies (or that can be used, together with other information or data, to personally identify) an End User.

  • Product Data are illustrations, standard schedules, performance charts, instructions, brochures, diagrams, and other information furnished by the Contractor to illustrate materials or equipment for some portion of the Work.

  • User Data means any Personal Data or other data or information collected by or on behalf of the Company or any of its Subsidiaries from users of any Company Product or website of the Company or any of its Subsidiaries.

  • Technical data means recorded information, regardless of the form or method of the recording, of a scientific or technical nature (including computer software documentation). The term does not include computer software or data incidental to contract administration, such as financial and/or management information.

  • Customer Data means any content, materials, data and information that Authorized Users enter into the production system of a Cloud Service or that Customer derives from its use of and stores in the Cloud Service (e.g. Customer-specific reports). Customer Data and its derivatives will not include SAP’s Confidential Information.

  • Supplier Materials has the meaning set out in clause 8.1(g);
